Welcome to Michi & Co. These Terms of Service govern your use of michico.co.za and any purchase made through our online store.

By accessing our website, placing an order or purchasing any product from Michi & Co, you agree to these Terms of Service together with our Privacy Policy, Delivery Policy and Returns & Refunds Policy.

Where applicable South African law provides rights that cannot legally be excluded or limited, those rights remain unaffected.

2. Online Store Terms

You may use this website only for lawful purposes.

By placing an order, you confirm that:

• the information you provide is accurate and complete;
• you are legally capable of entering into the transaction;
• you are authorised to use the payment method provided; and
• you have reviewed your product selections before completing your purchase.

You may not use our website or products for any unlawful or fraudulent purpose.

3. Our Products

Michi & Co sells handbags and accessories that may be purchased individually or combined to create different looks.

Customers are responsible for checking their selected:

• handbag;
• colour;
• strap;
• chain;
• charm;
• quantity; and
• any other product option

before completing checkout.

An item correctly supplied according to the customer's confirmed order is not considered an incorrect product merely because the customer later prefers another colour, style, accessory or combination.

4. Product Images and Colour

We make reasonable efforts to display our products as accurately as possible.

However, colours may appear slightly different depending on:

• screen settings;
• device display;
• lighting used in photography; and
• normal manufacturing variation.

Minor colour, texture, pattern or finish variations that do not materially change the product are not necessarily defects.

This is particularly relevant to patterned materials, hardware finishes and decorative accessories.

Nothing in this clause limits a customer's rights where a product is materially different from what was advertised or otherwise does not comply with applicable consumer law.

5. Handbag and Accessory Compatibility

Michi & Co accessories are designed to be used with suitable attachment points and hardware.

Customers should not force a strap, chain, charm, clasp or other accessory onto hardware for which it is not reasonably suited.

Michi & Co is not responsible for damage resulting from:

• excessive force;
• incorrect attachment;
• bending or altering clasps or links;
• overloading;
• dismantling hardware;
• unauthorised alterations; or
• use contrary to the product's intended purpose,

except where liability cannot lawfully be excluded.

Normal clipping and unclipping of interchangeable Michi & Co straps, chains and charms using their intended attachment mechanisms is, of course, considered normal use.

6. Orders

Submitting an order does not necessarily mean that Michi & Co has accepted it.

We reserve the right, where reasonably necessary, to refuse or cancel an order in circumstances such as:

• suspected fraud;
• unauthorised payment;
• an obvious pricing or product listing error;
• duplicate orders;
• products becoming unavailable;
• incorrect stock information; or
• circumstances that make fulfilment impossible.

If we cancel an order after payment has been received, any amount due to you will be refunded in accordance with applicable law.

7. Order Changes

Please check your order carefully before payment.

Requests to change an order after it has been placed are not guaranteed.

If your order has already entered processing, been packed or been dispatched, we may be unable to change the products, quantities or delivery information.

8. Prices

All prices displayed on the Michi & Co website are shown in South African Rand (ZAR) unless otherwise indicated.

The price payable is the price displayed and confirmed at checkout, subject to correction of obvious errors and applicable law.

Delivery charges, where applicable, are shown separately during checkout.

Michi & Co reserves the right to change product prices at any time. A later price change does not affect an order that has already been validly concluded, except where permitted by law.

9. Promotions and Discount Codes

Promotional offers may:

• be available for a limited period;
• apply only to selected products;
• require a minimum purchase value;
• exclude certain items;
• be limited to one use per customer; or
• have additional conditions displayed with the promotion.

Unless expressly stated otherwise, promotional codes cannot be exchanged for cash.

Michi & Co may withdraw or correct a promotion where there has been a genuine technical or pricing error, subject to applicable consumer legislation.

10. Payment

Payment must be completed using one of the payment methods offered at checkout.

Orders will not be processed as successfully paid until payment has been confirmed by our payment provider.

Michi & Co does not control delays or declined transactions caused by a customer's bank or payment service provider.

11. Delivery

Michi & Co currently delivers within South Africa.

Delivery charges and any free-delivery thresholds displayed at checkout form part of the order.

Estimated delivery times are provided in our Delivery Policy.

Delivery dates are estimates unless expressly agreed otherwise. Where applicable legislation provides customers with rights relating to delayed or failed delivery, those rights remain unaffected.

Customers are responsible for supplying a complete and accurate:

• delivery address;
• recipient name;
• telephone number; and
• other information reasonably required by the courier.

Additional delivery costs resulting from incorrect information supplied by the customer may be charged where permitted by law.

12. Risk During Delivery

Michi & Co will take reasonable steps to ensure that orders are appropriately packaged and handed to the relevant delivery service.

If a parcel arrives visibly damaged, customers should photograph the parcel and product and contact us as soon as possible in accordance with our Returns & Refunds Policy.

13. Returns and Refunds

Returns, damaged products, incorrect items, defects and refunds are governed by our separate Returns & Refunds Policy, which forms part of these Terms.

Michi & Co does not offer additional voluntary change-of-mind refunds or exchanges beyond the rights stated in that policy and those required by applicable South African law.

14. Reporting Visible Damage or Incorrect Goods

Customers are requested to inspect their order promptly after delivery.

Visible delivery damage, broken items or incorrectly supplied products should be reported to:

within 24 hours of delivery, together with clear photographs.

This reporting period helps us investigate courier damage and packing errors promptly.

The 24-hour request does not remove statutory rights relating to qualifying defects that could not reasonably have been identified within that period.

15. Product Care and Misuse

Customers are responsible for using and caring for products reasonably.

Damage resulting from the following will generally not constitute a manufacturing defect:

• ordinary wear and tear;
• overloading a handbag;
• excessive pulling on straps or chains;
• forced or bent clasps;
• scratches occurring after delivery;
• exposure to excessive moisture;
• perfume, cosmetics or chemicals;
• unsuitable cleaning products;
• incorrect storage;
• accidental damage;
• unauthorised repairs;
• modification or dismantling; or
• misuse.

This does not affect rights relating to genuine defects existing in the goods.

16. Intellectual Property

All content appearing on the Michi & Co website, including where applicable:

• logos;
• branding;
• photographs;
• graphics;
• product arrangements;
• website text;
• advertising material; and
• original creative content

belongs to Michi & Co or is used with appropriate permission.

Content may not be copied, reproduced, distributed, commercially exploited or used to represent another business without permission, except where permitted by law.

17. Customer Reviews and Submitted Content

If you submit a product review, photograph, comment or other content to Michi & Co, you confirm that:

• the content is yours or you have permission to submit it;
• it is not unlawful or fraudulent; and
• it does not infringe another person's rights.

Where you expressly give Michi & Co permission to use submitted content for marketing or promotional purposes, we may reproduce that content in accordance with that permission.

18. Third-Party Services

Those providers may have their own terms and privacy policies.

Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by law.

That qualification is important because the CPA restricts terms that unfairly require consumers to waive rights or supplier liability.

Nothing in these Terms prevents a consumer from exercising any remedy or approaching any forum available to them under applicable South African law.

constitute the terms applicable to purchases made through the Michi & Co website, together with any additional conditions clearly disclosed before purchase.
